The case against David and Collet Stephan was back in a Lethbridge courtroom this week.
A couple convicted two years ago of failing to provide the necessaries of life for their toddler son have missed a second deadline to possibly get funding for their re-trial.
According to the Lethbridge Herald, David and Collet Stephan were supposed to have filed their application for Legal Aid last week, noting previously they don't have enough money to proceed with the re-trial.
The Supreme Court of Canada granted the couple a new trial in May, stating the original trial judge’s charge to the jury was inadequate. Court heard during the Stephan's trial their son Ezekiel died due to bacterial meningitis after he was treated with natural remedies rather than being taken to see a doctor.
The couple now has until next Tuesday (Dec. 4) to file their Legal Aid application. Their four week long re-trial is scheduled for June next year.
